- Moderately Complicated Divorce starting at $7,500.00 plus expenses - Moderately complicated divorces means that there are some minor issues related to child custody, child support or health insurance for the children and there may be more community assets to divide, or those that require additional documents to transfer.
- Complex Divorce starting at $10,000.00 - Complex divorce means those divorces that include more unusual child custody terms, like a non-standard possession schedule, child support for disabled children, deviation from child support guidelines or health insurance for the children and may include the division of small business assets, spousal support, separate property of one or both parties, division of stock or other securities, etc.

McKinney Uncontested Divorce Lawyer
Divorce generally involves countless decisions about how to disentangle two lives intimately entwined physically, psychologically, financially, as parents, and in many other ways. This process can be painful, uncertain, and highly stressful. Leaving all the decisions up to a judge in a family court can lead to even more upset and dissatisfaction if you believe the results are unfair or inappropriate.
Resolving the decisions between you and your spouse outside of court can be the fastest, least expensive, and least stressful way to achieve a Texas divorce. This is called an “uncontested” divorce. This means that you and your spouse agree on all issues related to the termination of your marriage.

Uncontested Divorce in Texas
In an uncontested divorce, spouses must come to a mutual agreement on several key issues, including:
- Division of marital property and debts
- Child custody and visitation schedules (if applicable)
- Child support payments (if applicable)
- Spousal maintenance or alimony (if applicable)
The term "no-fault" divorce is essential to understand in this context. Texas is a no-fault divorce state, meaning you don’t have to prove fault, such as adultery or cruelty, to file for divorce. Instead, you can cite insupportable differences, which make uncontested divorces significantly more straightforward. Without the need for court hearings to prove fault, the process can move forward much faster.
The Process
The process of an uncontested divorce in Texas generally involves several steps. First, Texas residency must be established. At least one spouse must have lived in Texas for at least six months and in the county where the divorce is being filed for at least 90 days.
Next, you must file a divorce petition outlining the grounds for divorce and any other issues that must be addressed. If these issues have already been agreed upon, you will still be subject to a mandatory 60-day waiting period from the date the petition is filed before a judge can grant the divorce.
The divorce will be finalized after the waiting period if all issues are agreed upon. The judge will review and approve the agreement, issuing a final divorce decree.
Getting an uncontested divorce without the cooperation of your spouse can be challenging, depending on the circumstances. If your spouse fails to answer after being served with divorce papers, the divorce will go into a default judgment. This means the court will hear only your side of the story. However, the judge retains the authority to ensure the final decree is legal and fair.
If your spouse responds to the divorce paperwork by disagreeing with your proposed terms, the process may become a contested divorce, which often requires more time and resources. You still can engage in negotiations and other alternative dispute resolution methods to resolve the matter without litigation.
